1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of RallyFind ("RallyFind," "we," "us," or "our") and all related services (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

RallyFind is intended solely for individuals who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old. We reserve the right to suspend or terminate accounts that violate this requirement.

3. Description of Service

RallyFind provides an online platform that allows users to connect with other tennis and pickleball players to organize matches, practices, and related activities. RallyFind does not host events, supervise matches, verify users, or guarantee the accuracy of any user-provided information.

RallyFind acts solely as a technology platform to facilitate introductions between users.

4. Account Registration and Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to provide accurate information and keep it updated.

We reserve the right to suspend or terminate accounts at our discretion, including for violations of these Terms.

5. User Content

Users may post profiles, match listings, messages, and other content ("User Content"). You are solely responsible for your User Content.

By submitting User Content, you grant RallyFind a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely for the purpose of operating the Service.

We reserve the right (but not the obligation) to remove any content or suspend users at our discretion.

6. Acceptable Use

You agree not to:

• Harass, threaten, or harm other users.
• Post false, misleading, or fraudulent information.
• Engage in illegal activity.
• Use bots, scrapers, or automated systems to access the Service.
• Interfere with the operation or security of the platform.

Violation of these rules may result in account suspension or termination.

7. Assumption of Risk and Release of Liability

RallyFind does not conduct background checks and does not verify the identity, skill level, or safety of users.

You acknowledge that participating in tennis, pickleball, or other physical activities involves inherent risks, including risk of injury or death.

By using the Service and participating in matches or events arranged through RallyFind, you voluntarily assume all risks associated with meeting other users and participating in athletic activities.

You agree that RallyFind is not responsible or liable for:

• Injuries or damages arising from participation in matches or activities.
• Actions or conduct of other users.
• Disputes between users.
• Loss, theft, or damage to personal property.

You hereby release and hold harmless RallyFind from any claims, demands, damages, losses, or liabilities arising out of or related to your use of the Service or participation in any in-person activity.

8. Skill Ratings Disclaimer

Skill levels and ratings displayed on RallyFind are self-reported by users unless otherwise stated. RallyFind does not verify or guarantee the accuracy of any rating or representation of skill level.

9. Future Paid Features

The Service is currently free. However, RallyFind reserves the right to introduce paid features in the future, including but not limited to match boosts, featured listings, subscriptions, or coach listings.

If paid features are introduced, additional terms may apply and will be presented before payment is required.

10. Intellectual Property

All content, trademarks, logos, and software associated with RallyFind (excluding User Content) are the property of RallyFind. You may not copy, reproduce, or distribute platform materials without written permission.

11. Limitation of Liability

To the fullest extent permitted by law, RallyFind shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, personal injury, or property damage.

RallyFind's total liability for any claim arising out of or relating to the Service shall not exceed one hundred U.S. dollars ($100).

12. Indemnification

You agree to defend, indemnify, and hold harmless RallyFind from and against any claims, damages, liabilities, losses, and expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another person.

13. Arbitration Agreement

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in San Diego County, California.

You waive the right to a jury trial and agree that disputes will be resolved on an individual basis, not as part of any class or representative action.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

15. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
